The BMA, having taken legal action on behalf of doctors who have suffered detriment on the grounds of age discrimination, has also been closely monitoring the developments of the case brought by the FBU (Fire Brigades Union), who yesterday secured victory at the Employment Tribunal.
The legal action being brought by the BMA on behalf of its members on the same issue was put on hold pending the outcome of the FBU’s case. The implications of the ruling are clear and having already conceded that the transition to the 2015 scheme discriminated against younger doctors, we hope that the Government will now move quickly to remedy this in light of the judgment and compensate all affected members for the losses they have suffered.
The BMA is aware that some law firms are actively trying to recruit doctors to bring a case, and all no doubt charge a fee on any payment secured. Doctors do not need to sign up with these firms as any agreed remedy as a result of the BMA’s actions will automatically apply to all doctors.
