Crown witness fees

Effective date: 1 May 2003

Mileage (by agreement with the BMA) 45.0p per mile or 25.4p per mile for motorcycles.
Notes:
1) The CPS normally pays mileage at the public transport rate of 25.0p per mile or 23.8p per mile for motorcycles.

2) Where a passenger whose travelling expenses would otherwise have been paid is carried, the mileage rate shall be increased by 2p for the first passenger and by 1p for each additional passenger.

1. Ordinary witness allowances
a) Subsistence expenses:
up to 5 hours - £2.25
up to 10 hours - £4.50
in excess of 10 hours - £9.75
overnight stay (inner London) - £95.00
overnight stay (elsewhere) - £65.00
 
b) Loss of earnings:
up to 4 hours' absence - £32.30
in excess of 4 hours' absence - £64.65
 
c) Financial loss allowance in respect of expenditure incurred - £64.65

2. Professional witness allowances
a) Subsistence for overnight stay:
inner London (within 5 miles of Charing Cross) - £85.25
elsewhere - £55.25
   
Either:
b) Attendance allowance
less than 2 hours' absence from practice - £83.50
less than 4 hours' absence from practice - £117.00
less than 6 hours’ absence from practice - £174.00
Over 6 hours - £234.00
 
Or:
c) Locum allowance
for a period not exceeding 2 hours - £89.00
for a period not exceeding 4 hours, subject to the point below - £125.00
for a period not exceeding 4 hours but where it was not practicable to provide a locum for less than 4 hours - £250.00
for a period exceeding 4 hours - £250.00

3. Expert witness – guidance issued by CPS Headquarters
a) Subsistence for overnight stay:
inner London (within 5 miles of Charing Cross) - £85.25
elsewhere - £55.25
 
b) Consultant
i) Preparation (per hour) £70.00 – £100.00
ii) Attendance at court (full day) £346.00 – £500.00
 
c) Other doctors
i) Preparation (per hour) £47.00 – £100.00
ii) Attendance at court (full day) £226.00 – £490.00
 
Note: Expert witness fees are not fixed; the fee is negotiated for each attendance. Expert witnesses should contact the area office of the CPS for advice.
